ST. PAUL, MN – A Minnesota woman, who was 36 weeks pregnant, has filed a federal lawsuit against Boar’s Head Provisions Co., Inc. after suffering a severe Listeria infection. The lawsuit, the first of its kind in response to a multistate Listeria outbreak, was filed in the District of Minnesota under case number 24-cv-3151.
According to the complaint, the woman developed the life-threatening infection after eating Boar’s Head deli meat purchased from a Publix grocery store in Florida.
The infection led to her hospitalization, but thankfully, both the mother and her unborn child survived the ordeal.
Listeria: A Serious Threat to Pregnant Women
Listeria is known to be particularly dangerous for pregnant women, with the Centers for Disease Control and Prevention (CDC) reporting that they are 10 times more likely than others to contract the infection.
The risks associated with Listeria during pregnancy are severe, including miscarriage, premature birth, low birth weight, and even infant death.
The infection can also be passed from mother to fetus, potentially leading to a range of serious health problems for the baby, such as intellectual disabilities, seizures, blindness, and organ impairments.
Brendan Flaherty, a partner at OFT Food Safety & Injury Lawyers, who is representing the plaintiff, emphasized the gravity of the situation.
“The impact of Listeria on expectant parents is both devastating and terrifying,” Flaherty stated. “Often, the pregnant woman experiences few symptoms while the bacteria silently threatens the fetus. The human toll is so significant that food producers must take every possible precaution to detect and eliminate Listeria in their facilities.”
Boar’s Head Deli Meat Recall Amid Growing Listeria Outbreak
The lawsuit comes amid a broader Listeria outbreak linked to deli meats, which has so far affected 34 people across 13 states, resulting in two deaths.
The outbreak, which began in early June 2024, has led to a widespread recall of Boar’s Head deli meats produced at its Virginia facilities.
Listeria contamination has long been associated with deli meats, and the current outbreak underscores the persistent risks within the industry.
