AUSTIN, TX — In an unexpected legal twist, drivers in Texas are being cautioned that loading up on coffee before hitting the road might not be as harmless as it seems. Many drivers associate DWIs strictly with alcohol or illegal drugs, but Texas law takes a much broader approach. Legal expert Justin Sparks emphasized that any substance—whether over-the-counter or perfectly legal—can result in a driving while intoxicated (DWI) charge if it compromises the driver’s ability to operate a vehicle safely. That includes something as common as caffeine.
When consumed moderately, coffee helps drivers stay alert. But when downed in extreme quantities, caffeine can trigger anxiety, jitteriness, erratic movements, and poor concentration—symptoms that could raise red flags for law enforcement officers monitoring roadway behavior. Sparks stressed that these extreme effects, although rare, could be enough to justify legal consequences.
A Grey Area with Serious Consequences
Although no known cases have led to a DWI based solely on caffeine intake, the law does not require the substance to be illegal or intoxicating in a traditional sense. It only needs to impair driving. Texas isn’t alone in this legal interpretation—other states also leave room in their statutes to charge drivers impaired by any substance, whether it’s cold medicine, prescription pills, or even energy drinks.
The lawyer clarified that incidents involving caffeine are highly uncommon. However, the principle remains clear: any impairment—regardless of the source—can potentially trigger arrest, license suspension, or court action.
New Laws Shake Up Roads in Florida and Hawaii
Meanwhile, Texas isn’t the only state grappling with shifting traffic rules. In Jacksonville, Florida, legislation is under review that could outlaw food trucks from setting up shop at gas stations, citing serious fire risk due to proximity to fuel tanks. That ordinance is expected to be voted on by the City Council by April 8.
Out west in Honolulu, Hawaii, drivers are facing another change—photo speed enforcement. Warning letters are now going out to car owners after officials installed 15 speed cameras citywide. One intersection in particular—School Street at Likelike Highway—has become a speeding hotspot, now blanketed with four separate cameras. State officials admit, however, that the placement of these devices is heavily restricted by local laws.
